The Garden Hustle & Scotts Competition- Create your better, greener garden space with Scotts
TERMS & CONDITIONS
1. Information on how to enter and prizes form part of these terms and conditions. By participating in the Promotion, you agree to be bound by these terms and conditions and any additional requirements set forth on the competition website.
Eligibility:
2. The "Create your better, greener garden space" Online Competition ("Competition") is open to all residents of Australia who are 18 years of age or older at the time of entry. Affiliates and agents, of the Promoter, Ambience Entertainment Pty Ltd and Evergreen Garden Care and any of their employees, directors or officers or any of their family members or persons living in the same household as any of the foregoing, are not eligible to participate.
3. Automated or robotic entries submitted by individuals or organisations will be disqualified. Internet entry must be made by the entrant. Any attempt by an entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, logins or any other methods, including, but not limited to, commercial contest/sweepstakes subscription notification and/or entering services, will void that entrant's entries and that entrant may be disqualified.
How to Enter:
4. The Promotion commences on Saturday, 18th November and ends at 12:00pm AEDT Saturday, 2nd December (“Promotional Period”). Any entries received before or after the Promotion Period will not be eligible.
5. To enter online go to www.thegardenhustle.com.au/win and follow the prompts on the competition entry page:
a. At the competition entry page, complete the entry form (including your full name, email and address)
b. Answer in 250-words or less, the competition question: “What would a better, greener garden space mean to you and your friends/family and how would the Scotts Osmocote pack make it easier for you to create your space”.
c. Upload 1 high quality image of the space you want to makeover and 1 image of ideas/inspiration. Note shortlisted entries may be contacted to provide additional images.
6. Only one entry per person will be permitted.
7. Any costs associated with entering the Promotion, including data costs, are the entrant’s responsibility.
8. You must not engage in any illegal or unsafe behaviour whilst participating in the Promotion (including while taking the entry photograph). To the extent permitted by law, the Promoter and its partners, including Evergreen Garden Care and the Nine Network exclude any legal liability or responsibility for incidents or activities, whether legal or otherwise, engaged in by you or any other person during participation in the Promotion (including while taking the entry photograph).
9. You warrant to the Promoter that your entry is an original work that does not infringe the rights of any person. You warrant that you own or have all necessary licences, rights, consents, and permissions to use and authorise the Promoter to use all trademark, trade secret, copyright or other proprietary rights in and to your entry to enable inclusion and use of your entry in the manner contemplated by these terms and conditions. If any part of the information provided by you in relation to your entry was provided by a third party, you warrant that you have obtained the relevant copyright permission to submit the entry for the purposes of the Promotion.
Prize:
10. The best 3 valid entries as determined by the judges will win the following prize:
a. Products valued at $250 from Evergreen Garden Care Australia.
11. To redeem Evergreen Garden Care products the 3 winners will be sent a $250 Bunnings voucher.
12. The winners must take the prize as offered. The prize, or any unused portion of the prize, is not exchangeable and cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer.
13. If, for any reason, the winners don’t take the prize at the time stipulated by the Promoter, the prize will be forfeited by the winners and cash will not be awarded in lieu of the prize.
14. If a prize, or part of a prize, is unavailable, the Promoter may substitute an alternative prize to substantially the same recommended retail value and/or specification, subject to any written direction from the various regulatory authorities.
15. The prize will be delivered to the nominated email address of the winner. The Promoter is not responsible or liable for any delay or failure in delivery of the prize by a third party or for any damage caused to the prize during delivery.
16. In accepting the prize, the winners acknowledge that they may incur ongoing costs associated with the prize that are the responsibility of the winners.
17. The prize is subject to the standard terms and conditions of individual prize and service providers.
Winner Selection:
18. The Promotion is a game of skill; chance plays no part in determining the winners. Each entry will be individually judged based on its literary, artistic and creative merit. The judges’ decision will be final and binding on every person who enters. No correspondence will be entered into.
19. The judging will be conducted by a panel of judges appointed by the Promoter. The judging will take place at Garden Hustle Pty Limited, 55 Chandos Street, St Leonards, NSW 2065 and will begin on Monday, 4th December 2023.
20. The winners will be notified using the contact details provided on the entry on Tuesday, 5th December 2023. The winners name will be published during The Garden Hustle episode, across The Garden Hustle website and on The Garden Hustle social media channels on Saturday, 16th December December 2023.
21. You grant to the Promoter an irrevocable, worldwide and perpetual licence to use your entry in any manner and for any purpose at its absolute discretion, including using your entry in connection with promotional, marketing or publicity purposes without any further reference or payment or other compensation to you. The Promoter may amend, edit, select, crop, retouch, add to or delete from any part of your entry.
General:
22. The Promoter’s decision in relation to all aspects of the Promotion is final and no correspondence will be entered into.
23. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster) the Promoter may cancel, terminate, modify or suspend the Promotion.
24. The Promoter collects personal information (“PI”) to conduct the Promotion and to announce the winners of the Promotion, and may disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to regulatory authorities. Entry in the Promotion is conditional on providing this PI. The Promoter will also use and handle PI as set out in its privacy policy, which is available at www.thegardenhustle.com.au/privacy-policy. In addition to any use that may be outlined in the Promoter’s privacy policy, the Promoter may also, for an indefinite period, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning you. You should direct any request to opt out, access, update or correct PI to the Promoter and direct any complaints regarding treatment of your PI as set out in the Promoter’s privacy policy. All entries become the property of the Promoter.
